Contest Rules
The New Pulse FM / WPLW-FM General Contest Rules
Revised as of July 1, 2025
New Age Communications, Ltd. (the “Company”) may, from time-to-time, conduct various contests and sweepstakes in connection with radio station The New Pulse FM / WPLW-FM (each, a “Contest”). By entering any Contest, entrants agree to be bound by these General Contest Rules and any applicable Specific Rules.
Specific Rules include contest entry procedures, eligibility restrictions, prize details, deadlines, and winner selection methods. In case of conflict, Specific Rules control. The General Rules and Specific Rules are collectively referred to as the Contest Rules.
1. General

No purchase necessary. Making a purchase does not increase chances of winning.

Void where prohibited or restricted by law.

The Contest is governed by all applicable federal, state, and local laws.

By entering, entrants agree to follow all laws and Contest Rules and accept all decisions of the Company.
2. Eligibility

Open to legal U.S. residents in North Carolina, and Halifax, Mecklenburg, and Brunswick Counties, Virginia, 18 years or older at entry.

Limit one winner per household and one winner per immediate family.
-
Employees and contractors of the Contest Parties, and their immediate families, are not eligible.
Immediate family includes: spouses, grandparents, parents, siblings, children, grandchildren, in-laws, and any person residing in the same household.
Contest Parties: Company, sponsors, co-sponsors, prize providers, and affiliated entities.

No groups, clubs, or organizations may participate.

Proof of age, identity, and eligibility must be provided on request.

Past winners within 30 days are ineligible.

Company reserves the right to disqualify entrants who do not follow Contest Rules.
3. How to Enter

Entry procedures and deadlines are governed by Specific Rules. All times refer to Eastern Time.

Entries must be received during the entry period to be valid.

Company is not responsible for lost, late, incomplete, illegible, or damaged entries.

Automated or photocopied entries are void.
-
Electronic entries must be submitted by the authorized account holder.

Call-in entries may experience delays if listening via online streaming.
Entry Materials:

Entrant must own/control all rights to submitted materials.
-
Materials cannot violate copyright, trademark, privacy, or publicity rights.

Entrant grants Company a perpetual, worldwide, royalty-free license to use materials.
-
Materials may not include personally identifiable information of minors or offensive content.
Dates and times may change due to technical issues, emergencies, or breaking news.
4. How to Win

Winner selection is determined by Specific Rules and may be random or skill-based.

Winners notified via phone, email, mail, or other method in Company’s discretion.
-
Winners must respond within 30 days or prize may be forfeited.
-
Winners and guests may be required to sign forms, provide ID, or transfer intellectual property rights.
-
Failure to comply may result in disqualification and selection of an alternate winner.
5. Publicity Release

By entering, entrants grant Contest Parties the right to use their name, city, photo, likeness, biographical material, voice, feedback, and entry content for publicity and promotion without compensation.
6. Prizes

Prizes are awarded as described in Specific Rules.

Company may conduct a random drawing if more prizes are claimed than available.

All taxes, fees, transportation, parking, and other expenses are the responsibility of the winner.

Prizes are non-transferable; no cash redemption or substitution allowed, except at Company’s discretion.

Company is not responsible for lost, stolen, delayed, or damaged prizes.
7. Odds of Winning

Random selection contests: odds depend on number of eligible entries.

Skill-based contests: odds cannot be quantified.
8. Terms, Conditions, and Liability
-
Any attempt to tamper with the Contest may result in disqualification and legal action.

Winners release Contest Parties from liability for claims, damages, or losses related to the Contest, prize, or participation.

Company is not responsible for technical errors, website issues, or prize-related incidents.
-
Prizes valued at $600+ require a Social Security number for tax purposes.
9. Force Majeure / Disclaimer / Internet

Company may cancel, terminate, or modify the Contest due to technical issues, fraud, acts of God, pandemic, or other uncontrollable events.

Participants attempting to hack, cheat, or harm the Contest will be disqualified and may face legal action.

Company assumes no responsibility for computer or network failures, delays, or damages.
-
No warranties or guarantees are provided with any prize.
10. Arbitration / Choice of Law

Disputes will be resolved via arbitration under American Arbitration Association rules, limited to out-of-pocket costs, unless prohibited by law.

Governed by North Carolina law. Arbitration in Wake County, NC.

If arbitration is prohibited, disputes will be handled by courts in Wake County, NC.
-
Invalid provisions do not affect the enforceability of other rules.
-
No class actions; awards limited to actual out-of-pocket costs.
11. List of Winners

To request a list of winners, mail a self-addressed stamped envelope within 60 days of the contest end to:

12. Contest Sponsor
-
New Age Communications, Ltd. / The New Pulse FM / WPLW-FM is the sole sponsor.
-
Contests requiring social media interactions are not sponsored or endorsed by third-party platforms (Instagram, Facebook, etc.).
